The Recent Updates You Need to Know About the Tylenol Lawsuit

Millions of people daily use Tylenol or acetaminophen under generic names to treat minor to moderate pain and fever. Acetaminophen has long been regarded as the most secure over-the-counter pain treatment for expectant mothers.

However, numerous product liability claims have been brought by pregnant women who used Tylenol or generic acetaminophen and whose offspring have been diagnosed with autism spectrum disorder or attention deficit hyperactivity disorder.

A request to combine the cases into multidistrict litigation has been made due to the rise of Tylenol autism lawsuits MDL. On September 29, 2022, the Judicial Panel of Multidistrict Litigation heard the motion -JPML. On October 5, 2022, the JPML court formed the MDL; the task was entrusted to Hon. Denise L. Cote of the District Court for the Southern District of New York in the USA. In an MDL, similar cases are grouped to be decided in one court rather than placing all plaintiffs together in one complaint. This is similar to a class-action lawsuit in that many individuals who share the same criterion are merged to help them speed up the process.

December 2022: After the U.S. District Judge judging over the acetaminophen litigation issued a ruling and order in November 2022 refusing the retailer’s move to dismiss ADHD and autism cases filed by two families, Walmart filed a request for an expedited appeal. The filing of hundreds of further claims may be put on hold while the U.S. Court deliberates the Second Circuit of Appeals.

November 16, 2022: To serve in various leadership capacities throughout the proceedings as the federal MDL’s organizational structure was created, the court designated a group of 22 Tylenol autism lawyers. On matters relevant to numerous cases, these attorneys will act in the best interests of all plaintiffs. To prove that Tylenol was responsible for the child’s diagnosis of autism, each plaintiff will continue to work with a different lawyer. The team members included Alex Abston, Rachel Lanier, Mark Lanier, Ashley Keller, Mikal Watts, Catherine Heacox, Sarah Abston, and Cristina Delise. October 20, 2022: An order for an acetaminophen litigation for all autism and ADHD litigation was made in response to the dangers of using Tylenol or other similar medications during pregnancy. Senior U.S. District Judge Denise Cote will rule over all matters in the Southern District of New York. The initial status conference is slated to take place on November 17.

September 2022: The U.S. JPML heard legal arguments on September 29, 2022, in St. Louis, Missouri, to decide whether to consolidate the acetaminophen pregnancy lawsuits for autism under a single judge for integrated committal hearings in a multidistrict action.

July 2022: The generic acetaminophen manufacturers and retailers resisted the aggregation of the claims, arguing that there needed to be more cases filed to justify centralization.

June 2022: On June 10, a group of plaintiffs submitted a motion (PDF) to the U.S. Judicial Panel on Multidistrict Litigation (JPML) requesting the consolidation of lawsuits involving acetaminophen and autism lawsuits involving acetaminophen and ADHD filed in federal courts. The motion does not mention any Tylenol lawsuits filed regarding the consumption of the name-brand medication.

May 2022: Increasing numbers of acetaminophen-based painkiller Tylenol lawsuits claiming the drug causes autism and ADHD are being submitted to district courts across the country.

Liability claims for pharmaceuticals and other products are frequently settled. As of December 2022, the Tylenol autism lawsuit is still pending, making it difficult to forecast how much money the plaintiffs will receive.
