Accidents can be prevented but are not inevitable. Most people rely on the fact that most drivers are insured and have the insurance company take care of all accident-related expenses. However, some people find themselves in accidents involving uninsured drivers, leaving them with many questions. One of the main questions is if they can get compensation for their injuries, what to do after the accident, and if they should hire a personal injury lawyer. Below are a few things you should do after an accident with an uninsured driver.

File a Police Report

The first step to pursuing uninsured driver claims is to file a police report; this is usually immediately after the accident. The motorist may try to convince you against filing a report, citing various problems. However, keep in mind that failing to report the accident may prevent you from getting compensation from your insurance company or any other third party. Failing to file the report may also make it difficult for authorities to prove who caused the accident, forcing you to face legal penalties. Remain at the scene of the accident, call the police and file an official report.

Do Not Accept Liability for the Accident

Even if it’s partial liability, accepting liability for the accident makes you liable for a percentage of the damages. Avoid making statements that may suggest liability for the accident; this is because the other driver may use this against you. In some cases, accepting liability makes your insurance pay for the other driver’s injuries and car damage instead of yours.

Seek Medical Care and Assessment

Even if you seem fine after the accident, it’s best to seek medical evaluation and care. This way, the doctor can rule out internal injuries. Don’t take any risks with your health; go to the hospital; for urgent care. If you have any injuries, have them addressed before pursuing the case further.

Get In-touch with Your Insurance Company

Contacting your insurance company is the most important step when pursuing a claim against an uninsured motorist. If you sustain property damage or injuries, get in touch with your health and auto insurance providers. However, you should be cautious when dealing with the insurer since they have their own bottom lines. If anything, let your attorney handle the entire process.

  • File a claim on your behalf – the process of filing for a claim is complex and, in some cases, involves intimidation from insurance companies. With an attorney, you are well represented and your interests handled. An attorney ensures the maximum compensation is awarded under the law.
